These Terms and Conditions (“Terms”) govern your use of brd BOT’s robotic vending machines, websites, and any related account or rewards experiences, including the brd BOT rewards/account web app (collectively, the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

brd BOT may update these Terms from time to time. When we do, we will update the Effective date above. Your continued use of the Services after changes become effective means you accept the updated Terms.

You may be able to use the Services without creating an account. If you choose to use the rewards/account web app or otherwise participate in our rewards program, you may be asked to provide a phone number. You are responsible for providing accurate information and for maintaining control of your device and any verification codes sent to it. If you believe your account has been compromised, you must contact us promptly.

The Services allow you to place orders from brd BOT machines. Availability of items may vary by location and time, and we may change the menu, pricing, portions, or availability at any time. Estimated preparation times are not guarantees. We may refuse or cancel orders if we suspect fraud, misuse, or technical issues, or if required by law.

All sales are final except where required by law or where brd BOT determines, in its discretion, that a refund or credit is appropriate due to a machine error, an unfulfilled order, or another customer support issue. If you experience a problem with an order, you should contact support and provide the details requested so we can investigate. We may require proof of purchase, a transaction reference, or other information to resolve the issue. Refunds, if granted, may be issued to the original payment method or as a credit, depending on the circumstances and the capabilities of our payment providers.

You agree to use the Services lawfully and responsibly. You may not attempt to damage, disable, or interfere with any brd BOT machine or the software that operates it. You may not attempt to reverse engineer, exploit, probe, or access non-public systems or data, including by entering phone numbers or other identifiers to obtain information you are not authorized to access. You may not use the Services to harass others, engage in fraudulent activity, or violate any applicable laws or venue policies.

brd BOT may offer a rewards program, which may include features such as stamps, free items after a certain number of qualifying purchases, and randomized discounts or rewards such as a “wheel spin.” Rewards program rules may vary over time and by location. Unless we expressly state otherwise, rewards are non-transferable, have no cash value, may expire, and may be limited to one account per person or phone number. We may adjust rewards, thresholds, discount percentages, and eligibility rules to prevent abuse, comply with legal requirements, or improve the program. We may suspend, revoke, or withhold rewards if we reasonably believe there has been fraud, misuse, attempts to circumvent program rules, or any violation of these Terms. If a reward is tied to a paid purchase, brd BOT may define what constitutes a qualifying purchase and may exclude refunded, canceled, or disputed transactions.

Some brd BOT machine interactions may allow you to enter a phone number for a temporary session to identify a rewards account and display limited account information. Any such session is intended to be short-lived, may end automatically, and is cleared after the session. You understand that a machine is a public environment and you are responsible for protecting your information while using it. brd BOT is not responsible for consequences resulting from you sharing your phone number with others or using the machine in a way that exposes your account information to bystanders.

If you use the rewards/account web app, we may verify account access by sending a one-time passcode (OTP) to your phone number. You agree that OTP messages are necessary to provide account access and security. You must not attempt to access someone else’s account or use a phone number you do not control to create or access an account. We may limit repeated login attempts or messages for security and fraud prevention.

If you opt in to receive text messages from brd BOT, you agree to receive messages related to authentication, account activity, rewards updates, and, if you have specifically opted in, promotional messages such as offers and announcements. Message frequency varies. Message and data rates may apply. You can opt out of marketing texts at any time by replying STOP, and you can request help by replying HELP. Opting out of marketing texts does not prevent you from receiving transactional or security-related texts such as OTP codes, unless you stop all messaging or otherwise discontinue use of the Services. Wireless carriers are not liable for delayed or undelivered messages.

The Services and all related content, software, and trademarks are owned by brd BOT or its licensors and are protected by intellectual property laws. You may use the Services only for your personal, non-commercial use and only as permitted by these Terms. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services. We may suspend or terminate this license at any time if you violate these Terms or if we discontinue the Services.

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, brd BOT disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. brd BOT does not guarantee that the Services will be uninterrupted, error-free, secure, or available at any particular time or location, or that any item will be in stock. You acknowledge that using automated machines involves inherent risks, including occasional downtime, mechanical issues, or order errors.

To the fullest extent permitted by law, brd BOT will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from or related to your use of the Services, even if brd BOT has been advised of the possibility of such damages. To the fullest extent permitted by law, brd BOT’s total liability for any claim arising out of or relating to the Services will not exceed the amount you paid to brd BOT for the order or transaction that gave rise to the claim, or one hundred dollars, whichever is greater. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

You agree to indemnify and hold harmless brd BOT and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of another person.

These Terms are governed by the laws of the State of [State], without regard to conflict of law principles, except where prohibited by applicable law. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in [County, State], and you consent to personal jurisdiction in those courts, except where prohibited by applicable law.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. brd BOT’s failure to enforce any provision will not be deemed a waiver of that provision. These Terms constitute the entire agreement between you and brd BOT regarding the Services and supersede any prior or contemporaneous agreements on the subject.
